Former Bhartiya Janta Party MP and actress Jaya Prada was labeled an “absconder” on Tuesday by a court in Rampur, Uttar Pradesh. She has been evading authorities in relation to two cases of election code violations. The court has instructed law enforcement to detain her and present her in court by March 6.
This legal provision is activated when the accused does not show up in court despite non-bailable warrants. This triggers a proclamation process to secure their presence.
During the 2019 Lok Sabha elections, the former MP from Rampur faced legal action for purportedly breaching the Model Code of Conduct. Two cases were filed against them at Kemari and Swar police stations, as reported by senior prosecution officer Amarnath Tiwari.
The MP-MLA court issued multiple summons in these cases, yet the former MP failed to appear before it.
Following that, she received non-bailable warrants seven times; however, law enforcement failed to present her in court.
Jaya Prada, BJP’s representative from Rampur during the 2019 Lok Sabha elections, faced defeat against Azam Khan from the Samajwadi Party. Previously, she had been elected to the Lok Sabha from Rampur in 2004 and 2009 under the Samajwadi Party banner, but was later expelled by the party.
In its court response, the police stated that Jaya Prada was avoiding arrest, with all her known mobile numbers turned off, as per the prosecution officer.
Tiwari remarked that Judge Shobhit Bansal adopted a firm stance, classifying Jaya Prada as an absconder under Section 82 of the Code of Criminal Procedure (CrPC).
The Rampur Superintendent of Police has been instructed to assemble a team led by a circle officer to apprehend the actor-MP and present her in court for the upcoming hearing scheduled on March 6th.
